These Terms of Service (the “Terms”) govern your use of the text messaging services (the “Services”) provided by Digital Conversation LLC (“we,” “us,” or “our”). By accessing or using our Services, you agree to be bound by these Terms.
1. Agreement to Terms
By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our Services.
2. Description of Services
Our Services enable secure, timely, and efficient communication with you — including SMS, MMS, Voice, Video, and other related messaging services.
3. Message Disclosures (A2P 10DLC Requirements)
- Message and Data Rates: Message and data rates may apply for any messages sent to you from us and to us from you.
- Message Frequency: Message frequency varies per user based on account activity.
- Carrier Liability: Carriers are not liable for any delayed or undelivered messages.
4. Opt-Out and Support
STOP: You can cancel the SMS service at any time. Just text “STOP” to the short code or number. After you send “STOP” to us, we will send you a confirmation message that you have been unsubscribed. After this, you will no longer receive SMS messages from us.
HELP: For issues with the messaging program, reply with the keyword “HELP” for assistance, or contact support@digitalconversation.net.
5. Privacy Policy
Your use of our Services is also governed by our Privacy Policy, which explains how we collect and use your data. You can find our Privacy Policy at:

6. User Accounts and Registration
If registration is required, you agree to provide accurate, current, and complete information and maintain the security of your account credentials. You must notify us immediately of any unauthorized access.
7. Acceptable Use
You agree to use our Services in compliance with all applicable laws. You shall not:
- Send unsolicited messages (spam).
- Send unlawful, harassing, or harmful content.
- Impersonate any person or entity.
- Transmit viruses or harmful code.
8. Content and Ownership
- User Content: You retain ownership of the content of the messages you send. You grant us a license to process and transmit this content for the purpose of providing the Services.
- Our Content: All functionality of our Services is owned by or licensed to us and is protected by intellectual property laws.
9. Fees and Payment
If Services are offered for a fee, you agree to pay all fees in accordance with the payment terms provided. We reserve the right to change fees with reasonable notice.
10. Termination
We may suspend or terminate your access at any time, with or without cause, including for a breach of these Terms.
11. Disclaimer of Warranties & Limitation of Liability
- Warranties: Our Services are provided “AS IS” without warranties of any kind.
- Liability: To the maximum extent permitted by law, Digital Conversation LLC shall not be liable for any indirect or consequential damages. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Digital Conversation LLC from any claims arising out of your use of the Services or violation of these Terms.
13. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Nebraska. Any disputes shall be exclusively resolved in the state or federal courts located in Omaha, Nebraska.
14. Modifications to These Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Services constitutes acceptance of the revised Terms.
15. Entire Agreement
These Terms constitute the entire agreement between you and Digital Conversation LLC regarding your use of the Services.
